Article 1.
General
Placing an order implies the customer’s full and unreserved acceptance of the general conditions of sale.
If the customer of the huilerie de Lapalisse website does not accept the following general conditions of sale, he/she may not purchase the products offered for sale on this website.
No provision to the contrary in the terms of purchase, letters, acknowledgements of receipt or other documents issued by the customer may be invoked against www.huilerie-lapalisse.fr without the prior agreement of www.huilerie-lapalisse.fr. The information on the site is given for information only, and www.huilerie-lapalisse.fr may modify it at any time and without notice.
The general terms and conditions of sale may be modified by www.huilerie-lapalisse.fr. In the event of modification, the general terms and conditions of sale applicable are those in force on the day of the order.
Article 2.
Orders
All orders can be placed online and will only become final after acceptance by www.huilerie-lapalisse.fr.
The information provided by the customer when placing an order is solely binding on the customer.
Products are delivered to the delivery address indicated by the customer during the ordering process.
Any order implies acceptance of the price.
In the event of an error in the recipient’s details, false address, incomplete address, or failure to make a claim within the time allowed, www.huilerie-lapalisse.fr cannot be held responsible for the impossibility of delivering the products.
Any costs incurred for the reshipment of a parcel in the event of an error by the purchaser in the wording of the recipient’s details, will be re-invoiced to the customer.
L’Huilerie de Lapalisse reserves the right to cancel or interrupt any order from a customer with whom there are disputes relating to non-payment of a current or previous order.
Ordering a Product To place an order on the Site, the Customer must : Have the legal capacity to contract Have an address within the delivery area Have a bank account with sufficient funds to pay for the order online In order to add a Product to the shopping basket, the Customer clicks on the “Add to basket” icon.
They will then be invited to select their delivery method: In-store collection Home delivery: the customer will then be asked to enter their delivery address (in order to check whether their address is eligible for delivery).
Article 3.
Prices
The applicable prices are those indicated on the Site at the time the Customer validates his/her order. Prices are indicated in euros and include all taxes. Prices are subject to the French Value Added Tax (VAT) applicable on the day the order is placed. The Customer is informed that delivery charges will be invoiced in addition to the price of the Products, and that they will be specifically indicated for this purpose on the order summary and in the order confirmation e-mail. At any time and without prior notice, Huilerie de Lapalisse reserves the right to modify the prices of the Products, without such modifications affecting orders accepted by Huilerie de Lapalisse prior to the entry into force of such modifications. Huilerie de Lapalisse cannot be held responsible in the event of a manifest and gross error in price, and reserves the right to cancel orders on the grounds of low price.
Discounts
The discount codes to be entered in the shopping cart on the site offer a percentage discount applied to the amount of the shopping cart, excluding VAT, and exclude any shipping costs.
Discount percentages applicable to promotional offers are applied to the amount of the basket excluding tax, and exclude any shipping costs.
Article 4.
Payment
www.huilerie-lapalisse.fr offers customers 2 methods of payment for orders.
Payment can be made online by credit card or via a Paypal account.
By credit card: In order to proceed with the payment due, the customer must provide his/her credit card number, the expiry date and, if applicable, the visual cryptogram.
Paypal account: If the customer has a Paypal account, they can pay for their order on the www.huilerie-lapalisse.fr website via this payment method.
Paypal payments are completely secure.
The www.huilerie-lapalisse.fr website does not receive any banking information concerning the customer.
Article 5.
Delivery
Subject to special stipulation, the products listed in the electronic catalog of the www.huilerie-lapalisse.fr website are delivered in mainland France within 8 working days (excluding Saturdays, Sundays and public holidays) from the date of acceptance of the order by www.huilerie-lapalisse.fr as defined in article 2.
All deliveries exceeding 16 KG and to foreign countries, Corsica or French overseas departments and territories will be subject to a special quotation after contacting Echoppe des Saveurs by e-mail: The weight per parcel may not exceed 16 kg gross (product + packaging) for mainland France.
The delivery period begins upon receipt of your payment.
If the delivery deadline is exceeded and not justified by a case of force majeure, you may request cancellation of the sale under the conditions set out in article L.138-2 of the French Consumer Code, and obtain reimbursement of the sums already paid.
Delivery is deemed to have taken place upon receipt of the order by the customer.
It is the recipient’s responsibility to check his order on arrival and to make any reservations or claims that may prove justified to the POST office.
In the event of force majeure, if temporary, the contract is suspended unless the parties to the contract agree to an amicable termination of the contract.
Article 6.
Contribution to shipping costs
Delivery charges are independent of www.huilerie-lapalisse.fr, and may therefore change at any time, without www.huilerie-lapalisse.fr being held responsible.
Article 7.
Reservation of title
In accordance with law no. 80-335 of May 12 1980, www.huilerie-lapalisse.fr remains the owner of the goods delivered until full payment of the agreed price, in application of article 624-16 of the French Commercial Code.
It is expressly agreed that in the event of non-payment, www.huilerie-lapalisse.fr may demand, by registered letter with acknowledgement of receipt, the return of the goods in question, at the customer’s expense.
Article 8.
Liability
www.huilerie-lapalisse.fr cannot be held responsible for any damage of any kind that may result from misuse of the products sold.
Article 9.
Legal warranty of conformity
All products sold on www.huilerie-lapalisse.fr benefit from the legal guarantee of conformity (L211-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), enabling the User to return defective or non-compliant products.
Article 10.
Product availability
Our product offers and prices are available as long as they are visible on the www.huilerie-lapalisse.fr website and within the limits of available stocks.
In the event that one of our products is no longer or not immediately available, we will inform the customer by e-mail, telephone or post within 72 hours of order validation (excluding Saturdays, Sundays and public holidays).
If a product is definitively unavailable, we will offer the customer the replacement of the missing product by one or more other products of equivalent value, or a refund by bank transfer, credit note or cheque within 30 days.
In the event of temporary product unavailability, the customer may wait for the missing product to become available or request its replacement by one or more other products of equivalent value, or reimbursement by bank transfer within 30 days.
The customer may also order a substitute product available on the www.huilerie-lapalisse.fr website (subject to payment of an additional sum or partial reimbursement in the event of a price difference between the substitute product and the unavailable product).

Article 11.
Right of withdrawal
The customer is informed and acknowledges and accepts that L’Huilerie de Lapalisse distributes on the L’Huilerie de Lapalisse Site products that fall under the category of foodstuffs with a use-by date (DLUO), and perishable foodstuffs with a use-by date (DLC).
The customer must complete the withdrawal form, which can be downloaded here , and send it to the following address by registered mail with acknowledgement of receipt: Customer Service, Huilerie de Lapalisse – 38 avenue Charles de Gaulle 03120 Lapalisse.
Upon receipt, L’Huilerie de Lapalisse Customer Service will acknowledge receipt of the request by e-mail.
The Customer will enclose a copy of the invoice as well as a copy of the retraction form previously sent to the Customer Service Department. The maximum period for returning the Product(s) to Huilerie de Lapalisse is fourteen (14) days from notification to Huilerie de Lapalisse of the decision to retract.
The Customer bears the cost of returning the Products.
Only Products returned intact, complete, unopened, unconsumed and in their original packaging or any packaging suitable for the Product(s) concerned, and therefore in perfect condition for resale, may be reimbursed to the Customer.
In accordance with article L. 221-28 of the French Consumer Code, for health and safety reasons, any Product returned unsealed, i.e. opened, used, damaged or with packaging that is not intact, will not be eligible for the right of retraction and will therefore not be reimbursed.
The Customer is requested to keep proof of dispatch of the parcel containing the returned Products, failing which Huilerie de Lapalisse reserves the right to refuse reimbursement of any returned order that has not reached Huilerie de Lapalisse.
Under these conditions, L’Huilerie de Lapalisse undertakes to reimburse the Customer for the amount of the Products returned as well as the amount of the initial shipping costs (within the limit of standard shipping costs), to the bank account debited at the time of the order, within a maximum period of fourteen (14) days, from receipt of said Products sold by L’Huilerie de Lapalisse concerned.
Reimbursement of this sum will be deferred until receipt of the returned Products.
If the right of retraction is exercised after the date of departure of the aforementioned Products from the warehouses of L’Huilerie de Lapalisse, the return costs will remain the responsibility of the Customer.

Disputes
These terms and conditions of sale are governed by French law.
Complaints or disputes will always be received sympathetically, good faith always being presumed.

Article 13.
Full disclosure clause
The customer expressly declares that he/she has received from www.huilerie-lapalisse.fr all the information and advice required to enjoy the products ordered.

Use of personal information
The personal information collected for the purposes of distance selling is mandatory, as this information is essential for the processing and delivery of orders, as well as for the preparation of invoices.
Failure to provide this information will result in the order not being validated.
By creating an account, the customer agrees to receive offers and newsletters from www.huilerie-lapalisse.fr. If the customer does not wish to receive such offers and newsletters, he/she can specify this by writing to us at or by modifying the parameters of his/her customer account.

The performance of the obligations of the huilerie de Lapalisse under the terms of the present contract is suspended in the event of a fortuitous event or force majeure that would prevent its execution, unless the parties to the contract expressly agree to an amicable breach of contract.

In accordance with article 1, the placing of an order implies the customer’s full and unreserved acceptance of the present terms and conditions of sale, the said customer declaring that he/she has read the said terms and conditions beforehand and at the same time.
